Parent and Child Visa Q&A

To be eligible for the family visa as parent, your child must currently reside in the UK. Additionally, one of the following conditions must apply:

  1. Your child is a British or Irish citizen.
  2. your child has to be under age of 18 at the date of application
  3. Your child has settled in the UK, with proof of indefinite leave to remain, settled status, or permanent residence.
  4. Your child is from the EU, Switzerland, Norway, Iceland, or Liechtenstein and holds pre-settled status. They must have commenced living in the UK before 1 January 2021

Yes you can, however, you must meet all other requirements (contact our immigration lawyer for more information)

Yes you can but the other parent should not be your partner and additionally the other child’s parent must be either:

  • a British or Irish citizen
  • settled in the UK 
  • from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status – they must have started living in the UK before 1 January 2021

As of my last update in September 2021, the requirements for entry clearance as a parent in the UK are as follows:

  1. Relationship with the Child: your child should have a British citizen or settled status in the UK. You must have sole parental responsibility or direct access to the child.

  2. Financial Requirements: Demonstrate that you have sufficient financial means to support yourself and your child without relying on public funds during your stay in the UK. Financial requirements may vary based on the number of dependents.

  3. Accommodation: Ensure that you have appropriate accommodation in the UK that meets the legal housing standards and can accommodate both you and your child comfortably.

  4. English Language Proficiency: In most cases, you may be required to prove your English language proficiency by passing the language test. Please call for details

  5. Intent to Live in the UK: Provide evidence of your genuine intention to reside with your child in the UK for an extended period.

Under a parent visa you can stay in the UK for 2 years and 9 months on this visa. After this you’ll need to apply to extend your stay for another 2 years and 6 months.

You can apply to Indefinite Leave to remain when you are on a parent visa for 5 years.

No, You can apply for a child visa if one of your parents is living in the UK with a limited leave to enter or remain (only valid when the parent is in the UK under spouse visa or a family visa as a parent). Contact our immigration lawyer for further details.
